What does the strata law say about leaks between units?
Section 142 of the Strata Management Act 2013 presumes that a leak between floors comes from the unit above, unless its owner shows otherwise. Under the 2015 Regulations, the affected owner gives written notice to the developer, the JMB or the MC (regulation 56); it inspects within seven days (regulation 57) and certifies the cause and who must repair it (regulation 59).
Pipes that serve more than one unit are common property; a pipe that serves one unit is that unit’s. If either owner disputes the finding, the matter can go to the Commissioner of Buildings, and a leak in a new building may still be the developer’s under the defect liability period. This is a summary, not legal advice.
